It is intended to be read alongside our Privacy Policy, Cookie Policy, Terms of Use, and Returns Policy, each of which addresses a specific aspect of our relationship with visitors and customers in more detail. Nothing in this notice limits or overrides the rights described in those other documents; rather, it provides the underlying company and regulatory detail that supports them. Where we refer to "the company", "we" or "us", we mean Talvena Wellness Ltd.

3. Regulatory status and product classification

Elderberry Zinc is classified as a food supplement under UK food law and Regulation (EC) No 1924/2006 as retained in UK law, and is not a medicinal product; it is not licensed as a medicine and is not subject to medicines regulation by the Medicines and Healthcare products Regulatory Agency. As a food business, Talvena Wellness Ltd is required to comply with general food law, including labelling, composition, and safety requirements applicable to food supplements sold in the United Kingdom. The product must not be used as a substitute for a varied and balanced diet or a healthy lifestyle, must not exceed the stated recommended daily dose, and must be kept out of the reach of children, as stated on our product packaging and throughout this site.

4. Regulatory authorities

Food supplements in the United Kingdom are regulated by the Food Standards Agency, which sets and enforces general food safety and labelling standards, and by local authority trading standards and environmental health teams, which carry out practical enforcement. Data protection matters connected with our processing of personal data are overseen by the Information Commissioner's Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF, telephone 0303 123 1113, website ico.org.uk. Company registration matters are overseen by Companies House, and consumer protection matters more broadly are supported by the Competition and Markets Authority and by Citizens Advice, which offers free guidance to consumers on their statutory rights.

5. Data we collect via this website

Through talvena.world we collect personal data including your name and telephone number submitted through the order form, your delivery address once confirmed by telephone, and correspondence you send to [email protected], together with technical data such as your browser type and approximate location gathered automatically by our hosting and analytics providers. A full description of every category of personal data we collect, and the specific purpose for which each category is used, is set out in section 3 of our Privacy Policy, which forms the primary reference document for our data handling practices. This Legal Notice does not repeat that detail in full but confirms that Talvena Wellness Ltd is the data controller responsible for all such processing.

6. Legal basis for processing

We rely on the lawful bases permitted under Article 6 of the UK GDPR for our processing activities, principally the performance of a contract when taking and fulfilling your order, our legitimate interest in preventing fraud and operating our business efficiently, our compliance with legal obligations such as tax record-keeping, and your consent where required, for example for non-essential cookies. The specific basis relied upon for each category of data is explained in detail in section 4 of our Privacy Policy. We do not process special category data, such as health information, about our customers, and the order form does not request any such information.

7. Retention periods

As a general rule, order, delivery and financial records are retained for six years from the end of the relevant financial year, consistent with our obligations under the Companies Act 2006 and HM Revenue and Customs guidance on business record-keeping for VAT-registered companies. Correspondence unrelated to a completed order is retained for a maximum of 24 months, and cookie consent records are retained for 12 months, matching the validity of the consent given. Full detail on retention periods for each category of personal data is set out in section 5 of our Privacy Policy, and in the relevant sections of our Cookie Policy and Returns Policy where those documents describe more specific retention rules.

8. Your rights

As a data subject under UK data protection law, you have the right to request access to, correction of, or erasure of personal data we hold about you, the right to restrict or object to certain processing, and the right to data portability where applicable, all as described in full in section 6 of our Privacy Policy. To exercise any of these rights, contact [email protected] or telephone +44 117 289 4607, Monday to Friday, 9:00 to 17:30, or write to Talvena Wellness Ltd, 33 High Street, Bristol, BS1 2AW. We aim to acknowledge rights requests within 5 working days and to respond substantively within one calendar month, in accordance with statutory timeframes.

9. Third-party processors

We work with a defined set of third-party processors to operate our business, including Vercel Inc. for website hosting, Twilio Ireland Limited for order confirmation calls and delivery messaging, Royal Mail Group Ltd, DPD UK, and Evri Parcelnet Ltd as courier partners, Xero (UK) Limited for accounting, and Google Ireland Limited for business email and, where consented to, analytics. Each processor is engaged under a written agreement requiring appropriate technical and organisational security measures and confidentiality of any personal data they process on our behalf. A full description of the role played by each processor is set out in section 7 of our Privacy Policy.

10. Cookies

talvena.world uses a small number of strictly necessary cookies required for the order form and basic site functionality, and, subject to your consent, analytics cookies provided by Google Analytics 4 that help us understand aggregate site usage. No marketing or advertising cookies are currently active on the site. Exact cookie names, purposes, and lifespans are listed in full in our Cookie Policy, and you can manage your preferences at any time using the Cookie Settings link available in the footer of every page on this site.

11. International transfers

Where any of the processors named in section 9 store or process personal data outside the United Kingdom, for example in the United States, we require an appropriate safeguard recognised under UK data protection law to be in place before the transfer occurs, such as the UK International Data Transfer Addendum to the EU Standard Contractual Clauses, or a valid adequacy decision. This is described in more detail in section 9 of our Privacy Policy. We do not authorise any processor to transfer personal data internationally without such a safeguard being confirmed in advance.

12. Complaints and contact

Any complaint relating to this website, our processing of personal data, or the classification of our product should be sent in the first instance to [email protected] or by telephone to +44 117 289 4607, Monday to Friday, 9:00 to 17:30, and we will aim to acknowledge your complaint within 5 working days and to provide a substantive response within 20 working days.
